Definitions

For the purposes of these Terms and Conditions:
  • Company (referred to as either “the Company”, “We”, “Us” or “Our”) refers to Siam Sawadee Asian Decor Co., Ltd., based in Chiang Mai, Thailand.
  • Goods refer to the handcrafted wooden artworks, furniture, and other products offered for sale on this Website.
  • Service refers to the Website and related e-commerce platform operated at www.siamsawadee.com.
  • Buyer, Customer, or You means the individual or entity purchasing Goods from the Company.
  • Order means a request by You to purchase Goods from Us.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Service.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions. These Terms and Conditions apply to all visitors, users and others who access or use the Service.

By accessing or using the Service You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions then You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service.

Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Please read Our Privacy Policy carefully before using Our Service.

Placing Orders for Goods

By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts.

Your Information

If You wish to place an Order for Goods available on the Service, You may be asked to supply certain information relevant to Your Order including, without limitation, Your name, Your email, Your phone number, Your credit-card number, the expiration date of Your card, Your billing address, and Your shipping information.

You represent and warrant that: (i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct and complete.

By submitting such information, You grant us the right to provide the information to payment-processing third parties for purposes of facilitating the completion of Your Order.

Order Cancellation

Orders may be cancelled only if production has not yet started or the item has not yet been shipped. Once production has begun, cancellation may no longer be possible.
  • Standard items (short production): full refunds are issued if cancelled before dispatch, except that PayPal transaction fees (5 %) are non-refundable when payment was made via PayPal.
  • Custom or personalized items: the initial deposit (usually 50 %) is non-refundable once production has begun.
  • Furniture orders (made to order): Siam Sawadee reserves the right to retain up to 10 % of the item price (excluding shipping cost) to cover administrative and processing costs if the order is cancelled after production has begun but before shipment.
If an item is unavailable or if we fail to meet a guaranteed completion date, full refunds will be issued.

Furniture Orders and Processing Time

Furniture orders are made to order and typically require 4–6 weeks for production before shipment. Payment in full is collected at the time of order. If the buyer later decides to cancel due to production time, the above cancellation conditions apply.

Availability, Errors and Inaccuracies

We are constantly updating Our offerings of Goods on the Service. The Goods available on Our Service may be mispriced, described inaccurately, or unavailable, and We may experience delays in updating information. We cannot and do not guarantee the accuracy or completeness of any information, including prices, product images, specifications, availability, and services. We reserve the right to change or update information and to correct errors, inaccuracies, or omissions at any time without prior notice.

Handcrafted and Natural Variations

All Siam Sawadee products are individually handmade from reclaimed natural wood. Each piece is unique, and variations in grain, color tone, or carving details are normal and not considered defects. Minor differences between listing photos and the final item may occur due to natural materials, lighting, or camera differences.

Dimensions remain within ±1 inch tolerance. If a piece is smaller than listed by more than 1 inch, the buyer will be contacted before shipping and may choose to cancel with a full refund.

Prices and Shipping Policy

All prices on our Website are in USD.

Siam Sawadee reserves the right to adjust shipping costs prior to accepting an order in the rare event that courier rates to remote or high-cost destinations (for example, islands or rural areas) exceed our standard flat rate. Customers will be contacted within 24–48 hours of order placement if any adjustment is required. If the revised cost is declined, a full refund will be issued within 3–5 business days.

In very rare cases, if a discount or coupon has been applied in conjunction with a promotion that was not intended for combination, we may contact the customer to request a correction or additional payment. This only applies if the combined discount results in a sale below our cost.

Shipping and Delivery

We ship directly from Thailand to your door. Depending on the destination, your order will be shipped via FedEx, DHL, or in some rare cases, Thailand Post (which may take approximately 7–10 business days instead of 3–5 business days). Siam Sawadee reserves the right to select the carrier at its discretion based on reliability, route efficiency, and service availability.

Estimated delivery times are accurate in most cases but are not guaranteed by the courier. Delays may occasionally occur due to customs inspections, public holidays (in Thailand or in the destination country), natural events such as flooding, pandemics, international conflicts, or courier network disruptions.

If a courier delay exceeds three weeks without customs involvement, Siam Sawadee may assist in submitting a claim on behalf of the buyer, although reimbursement remains entirely at the courier’s discretion.

Couriers will not leave packages unattended unless the consignee authorizes it. If delivery is authorized without signature, it will be considered completed, and any theft or loss thereafter must be handled with local authorities.

If a parcel arrives visibly damaged, the consignee must ask the delivery person to note the damage in their system before signing for receipt. This is essential for insurance and claim processing.

If the buyer requests special delivery arrangements (specific delivery date, signature requirement, or address change) after dispatch, any additional courier charges incurred will be the buyer’s responsibility.

If tracking shows “delivered” but the parcel is not located, please first check with family members, household staff, security guards, or neighbors. Then contact the courier with your tracking number and also inform Siam Sawadee so we can assist in coordinating with the shipping company. If the courier confirms delivery to the address and the parcel is missing, it should be treated as theft and reported to your local authorities. Neither Siam Sawadee nor the courier can be held responsible for theft after delivery confirmation.

Import Duties and Customs Clearance

All orders are shipped from Thailand. Depending on your country’s import regulations, your local customs authority may require payment of import duties, taxes, or brokerage fees once your order arrives in your country. These additional charges are not included in the item price or shipping cost and are the buyer’s responsibility.

Your local customs authority or courier may require payment of these fees before releasing the shipment for delivery. In some rare cases, the courier may deliver first and invoice duties afterward.

Couriers such as FedEx or DHL typically charge a customs brokerage or handling fee, commonly around USD 10–20, depending on the destination country. These fees are collected directly by the courier during customs clearance and are not included in your payment to Siam Sawadee.

Buyers are responsible for submitting any documents requested by their local customs authority. If documents are required from the shipper, the courier would usually contact Siam Sawadee directly. We will promptly provide or assist with any required paperwork.

Failure by the consignee to pay duties or provide the requested documentation within the required time may result in storage fees, return, or disposal of the parcel by the customs authority. In such cases, no refund can be issued, as the order will be considered abandoned by the buyer.

If you believe customs have overcharged you or made a calculation error, please contact us and we will try to assist in clarifying the situation with the shipping company. However, Siam Sawadee has no control over customs decisions. Buyers concerned about specific import regulations are encouraged to check their country’s customs website or contact us prior to ordering.

Communication and Customer Support

For made-to-order items, Siam Sawadee sends photos of your actual item prior to shipping. If we do not receive a reply within 16 hours, we will proceed with shipment to avoid delay.

Siam Sawadee aims to reply to all customer emails within 24 hours, and within 48 hours during weekends, public holidays, or periods of high workload. If you have not received a response within that time, please send a follow-up email, as a message may occasionally be missed or misrouted.

Returns, Damages and Refunds

If your item is lost in transit and confirmed as lost by the courier, a full refund will be issued.

If your item arrives damaged, please notify us within 5 days of delivery and provide clear photos of the outer packaging and the damaged area. If damage is noted by the courier at delivery, ask them to record it in their system—this greatly assists the claim process.

Depending on the circumstances, resolutions may include repair, replacement, partial refund, or full refund, as agreed between both parties.

Clearance items (SALE section) are non-returnable and non-refundable, except in cases of damage or loss in transit.

Payments

All Goods purchased are subject to a one-time payment. Payment can be made through various payment methods we have available, such as Visa, MasterCard, American Express, or online payment methods like PayPal. Payment cards are subject to validation and authorization by Your card issuer. If we do not receive the required authorization, We will not be liable for any delay or non-delivery of Your Order.

Limitation of Liability

Notwithstanding any damages that You might incur, the entire liability of Siam Sawadee and any of its suppliers under any provision of this Terms shall be limited to the amount actually paid by You through the Service or 100 USD if You haven’t purchased anything through the Service. To the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages whatsoever.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided “AS IS” and “AS AVAILABLE” without warranty of any kind. Siam Sawadee disclaims all warranties, whether express or implied, including implied warranties of merchantability or fitness for a particular purpose.

Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of Thailand, excluding its conflict-of-law rules. Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Thailand.

Severability and Waiver

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect. Failure to enforce any right or provision of these Terms will not constitute a waiver of such right or provision.

Translation Interpretation

These Terms and Conditions may have been translated for convenience. In case of any discrepancy, the original English version shall prevail.

Changes to These Terms and Conditions

Siam Sawadee reserves the right, at its sole discretion, to modify or replace these Terms at any time. By continuing to access or use our Service after updates take effect, You agree to be bound by the revised terms.
